Anaheim Social Security Disability Insurance Lawyer

Anaheim, California, is a busy city located outside of Los Angeles in Southern California. With nearly perfect weather on a year-round basis, Anaheim is appealing to residents and visitors alike. While tourism is the primary industry in Anaheim, California, the city’s economy has become more economically diverse in recent years. Unfortunately, some residents of Anaheim are unable to work because of a disability. At Roeschke Law, LLC, our practice is dedicated to helping our clients obtain the Californian social security disability benefits they need and deserve.

Anaheim Social Security Disability Benefits Attorneys

Social Security Disability Insurance, or SSDI, is a benefits program that offers qualified individuals monthly payments. Individuals who are under the age of 65 and who have a qualifying disability, as well as sufficient work credits, are eligible for benefits. If you are an Anaheim resident who cannot work due to a disabling medical condition, our disability attorneys can help guide you through the process, from submitting an application to navigating a disability appeal. Founding attorney Kiel J. Roeschke is well-versed in the eligibility requirements for SSDI and has a well-earned reputation as a dedicated advocate of the disabled. When you become our client, you will have peace of mind knowing that our winning legal team is in your corner.

Qualifying for SSDI in Anaheim, California

To qualify for SSDI, an applicant must have held employment for a specified period. The applicant must have paid into the Social Security program as an employee and earned enough credits. Typically, an applicant earns four credits for every year he or she paid into the Social Security system. The amount of credits depends on the applicant’s self-employment income or yearly wages. The required credit amount changes from year to year and depends on the applicant’s age when he or she became disabled.

The Severity Test for Social Security Disability Insurance

The disabling condition must negatively interfere with basic work activities. Only conditions that preclude someone from working qualify for SSDI. All applicants must provide proof of their disabling conditions. The Social Security Administration (SSA) will ask you to provide medical documentation proving that the disabling medical condition can be found in the “Blue Book,” also called the Disability Evaluation under Social Security. The Blue Book lists 50 different medical conditions that automatically qualify applicants for Social Security Disability benefits.

What Qualifies as a Totally Disabling Condition?

In addition to having enough work credits, an applicant for SSDI must prove that he or she suffers from a totally disabling medical or health condition. The condition must prevent the applicant from doing the type of work he or she did before the onset of the disabling condition. Qualifying conditions must meet the following requirements:

  • The condition must prevent the applicant from working
  • The condition must have lasted or be expected to last at least 12 months or result in death

The SSA is serious about making sure applicants truly cannot work as a result of their injuries. The Administration will also determine whether or not the applicant can do any other type of work. They take the applicant’s age, work experience, and education into account when determining whether or not to approve the applicant.

The Medical Condition Cannot Be Temporary

If a medical condition is temporary and will get better with time, the applicant will not qualify for disability benefits. As an example, if an applicant was in a car accident that left him or her unable to work for 11 months and then returns work, he or she would not be eligible because Social Security disability benefits do not cover short-term or partial disabilities.

What is Supplemental Security Income?

Supplemental Security Income or SSI is another type of disability benefit offered by the Social Security Administration. This program is only available to those who are disabled, blind or aged 65 or older with limited financial resources. If you or a loved one is seeking benefits under the SSI program in Anaheim, the disability lawyers at Roeschke Law, LLC can help.
